You are responsible for all activities that occur under your account. An account may only be used by one person (except Enterprise plans with multi-user access).
Available Plans: - Starter: €59/month or €49/month (billed annually) — 25 credits - Pro: €149/month or €119/month (billed annually) — 90 credits - Agency: €299/month or €249/month (billed annually) — 200 productions (55 premium + 145 standard) - Enterprise: Custom pricing
Video Credits: - Each workflow has a fixed credit cost: Director = 1, Avatar Presenter = 2 (standard) / 3 (premium), Multi-Format Factory = 3, Inspiration Clone = 3, AI Influencer = 8, Brand Clone = 15 (standard) / 25 (premium) - Cost is per workflow execution, independent of generated video duration - Unused subscription credits expire at the end of each billing period - Additional pack credits do not expire as long as the account is active
Billing: - Payment by credit card via Stripe (international) or Payzone (Morocco) - Automatic billing at the start of each period - VAT applicable based on your country of residence
Cancellation: - You may cancel your subscription at any time - Access remains active until the end of the paid period - No pro-rata refund for unused credits
You agree NOT to use our Service for:
Illegal Content: - Content violating applicable laws - Content infringing intellectual property rights - Defamatory, hateful, or discriminatory content
Harmful Content: - Non-consensual deepfakes of real people - Disinformation or fake news - Sexually explicit or pornographic content - Violent content or content glorifying violence - Content targeting minors
Technical Abuse: - Attempts to bypass our security measures - Reverse engineering of our algorithms - Use of bots or unauthorized automation - Account sharing or credit resale
ANY VIOLATION may result in immediate suspension or termination of your account, without refund.
Your Content: - You retain all rights to the content you provide (images, text, logos) - You grant us a limited license to process this content to provide the Service - You warrant that you hold specific rights to the content provided
Generated Videos: - You own the videos generated from your content - You may use them freely for commercial purposes - We reserve the right to use anonymized videos to improve our models
Our Platform: - CinematicAds, its interface, algorithms, and brand remain our exclusive property - No intellectual property rights are transferred to you regarding the platform
Service provided "as is": The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, secure, or error-free.
Limitation of Liability: To the fullest extent permitted by law: - We are not liable for indirect, incidental, or consequential damages - Our total liability is limited to the amount paid during the last 12 months - We are not liable for content generated by AI models
Your Warranties: You warrant that: - You have the legal right to use any content you provide - Your use complies with all applicable laws - You will not violate the rights of third parties
You agree to defend, indemnify, and hold harmless CinematicAds, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from:
By You: - You may terminate your account at any time from your account settings - Termination takes effect at the end of the current billing period
By Us: We may suspend or terminate your access: - In case of violation of these Terms - In case of non-payment - For security or legal reasons - At our sole discretion with 30 days notice
Effects of Termination: - Your right to access the Service ceases immediately - Your generated videos will be deleted within 30 days - You may request data export before termination
We reserve the right to modify these Terms at any time.
Notification: - Material changes will be notified by email - We will display a notice on our platform - Minor changes will be reflected by the update date
Acceptance: Your continued use of the Service after notification constitutes your acceptance of the changes. If you do not accept the new terms, you must stop using the Service.
Governing Law: These Terms are governed by French law.
Dispute Resolution: - Any dispute will be subject to a prior mediation attempt - Failing amicable resolution, the courts of Paris shall have exclusive jurisdiction
Severability: If any provision of these Terms is held invalid, the other provisions remain in effect.
Entire Agreement: These Terms constitute the entire agreement between you and CinematicAds regarding the Service.
