Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CinematicAds platform, accessible at cinematicads.studio (the "Service"), operated by CinematicAds ("we", "our", "us"). By creating an account or using our Service, you agree to be bound by these Terms. If you do not accept these terms, you must not use our Service. These Terms constitute a legally binding contract between you and CinematicAds.

CinematicAds is a SaaS platform for AI-powered video ad generation. Our Service allows you to: - Generate video ads from text and/or images - Create multi-format videos optimized for different platforms - Add AI-generated voiceovers in multiple languages - Customize videos with your brand identity - Export videos in high quality (up to 4K) The Service uses advanced AI models, including Google Gemini and Veo, for content generation.

To use our Service, you must: - Be at least 18 years old or the legal age of majority in your jurisdiction - Provide accurate and complete information during registration - Maintain the confidentiality of your login credentials - Notify us immediately of any unauthorized use of your account You are responsible for all activities conducted under your account. An account may only be used by one person (except Enterprise plans with multi-user access).

Available plans: - Starter: $49/month or $39/month (annual billing) - Pro: $149/month or $119/month (annual billing) - Enterprise: Custom pricing Video credits: - 1 credit = 1 15-second video - Longer videos consume proportionally more credits - Unused credits expire at the end of each billing period Billing: - Payment by credit card via Payzone - Automatic billing at the start of each period - Applicable taxes based on your country of residence Cancellation: - You can cancel your subscription at any time - Access remains active until the end of the paid period - No pro-rata refund for unused credits

You agree NOT to use our Service for: Illegal content: - Content violating applicable laws - Content infringing intellectual property rights - Defamatory, hateful, or discriminatory content Harmful content: - Non-consensual deepfakes of real people - Misinformation or fake news - Sexually explicit or pornographic content - Violent content or glorification of violence - Content targeting minors Technical abuse: - Attempts to bypass our security measures - Reverse engineering of our algorithms - Unauthorized bots or automation - Account sharing or resale of credits Any violation may result in immediate suspension or termination of your account, without refund.

Your content: - You retain all rights to the content you provide (images, texts, logos) - You grant us a limited license to process this content to provide the Service - You warrant that you hold the necessary rights to the content provided Generated videos: - You own the videos generated from your content - You can use them freely for commercial purposes - We reserve the right to use anonymized videos to improve our models Our platform: - CinematicAds, its interface, algorithms, and brand remain our exclusive property - No intellectual property rights to the platform are transferred to you

Service provided "as is": The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, secure, or error-free. Limitation of liability: To the fullest extent permitted by law: - We are not liable for indirect, incidental, or consequential damages - Our total liability is limited to amounts paid in the last 12 months - We are not responsible for content generated by AI models Your warranties: You warrant that: - You have the legal right to use any content you provide - Your use complies with all applicable laws - You will not violate third-party rights

You agree to defend, indemnify, and hold harmless CinematicAds, its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from: - Your use of the Service - Your violation of these Terms - Your violation of third-party rights - Content you provide or generate through the Service

By you: - You can terminate your account at any time from your account settings - Termination takes effect at the end of the current billing period By us: We may suspend or terminate your access: - For violation of these Terms - For non-payment - For security or legal reasons - At our sole discretion with 30 days notice Effects of termination: - Your right to access the Service ceases immediately - Your generated videos will be deleted within 30 days - You may request export of your data before termination

We reserve the right to modify these Terms at any time. Notification: - Substantial changes will be notified by email - We will display a notice on our platform - Minor changes will be reflected by the update date Acceptance: Your continued use of the Service after notification constitutes your acceptance of the changes. If you do not accept the new terms, you must stop using the Service.

Governing law: These Terms are governed by French law. Dispute resolution: - Any dispute will be subject to a prior attempt at mediation - Failing amicable resolution, the courts of Paris will have exclusive jurisdiction Severability: If any provision of these Terms is found invalid, the other provisions remain in effect. Entire agreement: These Terms constitute the entire agreement between you and CinematicAds regarding the Service.
